The rules we submitted to the NCSBE are now in the hands of the Rules Review Commission for final approval. There are already dozens of comments urging the RRC to get rid of the rules. We want them fixed.


Please re-write the following rules into your own words. Feel free to submit more than one comment.  Email them to Alexander.Burgos@oah.nc.gov by Tuesday, August 18th, 2026.


08 NCAC 18.0504  IRREGULARITIES THAT DO NOT REQUIRE FURTHERT ACTION FROM THE VOTER


NCEIT PROPOSED COMMENTS: 

1.     Delete the entire rule as unnecessary and inappropriate under OAH standards. 

2.     The NCSBE again introduces a new term, “Irregularity,” which is not found in the NC General Statutes.  This term is not needed for rulemaking purposes.  Voting and absentee ballot package irregularities are numerous, and most are not included in this rule.

3.     Rules are not needed to specify situations where no regulated action or particular processing is needed.  There exist countless permutations of voter and election official actions which may not follow proper procedure, but which do not require rulemaking to remedy.  The two permutations of improper content preparation for absentee ballot return packages listed in this proposed rule are already understood and do not require rulemaking to manage.  These kinds of “irregularities” are best managed through policies or standard operating procedures.
