Comment on Irregularities That Require Further Action 18.0505

The rules we submitted to the NCSBE are now in the hands of the Rules Review Commission for final approval. There are already dozens of comments urging the RRC to get rid of the rules. We want them fixed.

08 NCAC 18.0505  IRREGULARLITIES THAT REQUIRE FURTHER ACTION

NCEIT PROPOSED COMMENTS: 

1.     This rule is not needed.  The term “irregularity” can be eliminated as unnecessary, and the instructions in this proposed rule can be migrated into 08 NCAC 18 .0502 (Curable Deficiencies).  Irregularities are simply deficiencies by another name.  “Deficiency” is the term used in the NC General Statutes and it should be used in rulemaking for clarity and consistency purposes.

2.     Eliminating this rule and migrating the content into .0502 simplifies the process for managing deficiencies in absentee ballot return packages.  The processing of curable and non-curable absentee ballot return packages is adequately described in 08 NCAC .0502 and .0503.
