Example Email: SUBJECT: Suggestions for H958 PCS - Election Law Changes (Very important to put this in your own words.) Dear Representative:
Thank you for developing H958 to improve our election system. However, I urge you to please consider additional significant changes to the H958 PCS and to pass the bill with the NCEIT suggested changes and to fix the deficiencies before the 2026 general election to restore voter confidence and election integrity. There should be no opportunity for foreign influence in our elections. The address of overseas voters must be verified through available state databases. Refinement of the voter registration application, registration process, qualifications of voters and use of HAVA documents for address verification is suggested to improve the quality of the voter registration list. NCEIT Talking Points for Revisions & Additions to H958 - PCSContributions by foreign nationals- There should be no exceptions to the definition of foreign nationals. - Foreign nationals should not be allowed to contribute money to N. C. elections. - National Chairman of the Election Transparency Initiative and former Virginia Attorney General Ken Cuccinelli issued the following statement: "We applaud House Republicans for the improvements already made to H958, however its section on foreign funding still falls short. Foreign billionaires and corporations should never be given the ability—under any circumstance—to buy North Carolina’s elections and undermine voters so they can affect changes to the state’s constitution. But the reality is that the bill in its current form, without additional amendments, will allow them to continue doing so with ease.”
Overseas voter's registration address (UOCAVA – Uniformed & Overseas Citizens Absentee Voting Act) - Thank you for proposing changes to UOCAVA voting, but previous NC residency must be verified using NC driver’s licenses or by checking state databases including those at the SBE, DMV, DHHS and Department of Revenue. In cases where the address is not verified, the county BOE address should be used to register the voter. - Address verification is required for in person and mail in voting. UOCAVA voting should be treated the same. - Over 60% of UOCAVA voters were civilian rather than military in 2024. That trend has been increasing for years. (In 2024 36% were uniformed military voters and 64% overseas civilian voters according to the Election Assistance Commission.) - Proof of citizenship should be required by providing a copy of the US passport. Voter Registration, Voter Registration Application Verification of Voters - The voter registration application should have required not requested information, so the voter can be verified. Full legal name and social security number helps avoid duplicate registrations especially with the many hyphenated names. Driver’s licenses should be current and valid, - There are millions of legal residents who are not citizens living in the US. Many of them have been improperly registered to vote. Proof of citizenship for new registrations is an important item to require on the application to increase accuracy and trust in the system. - An application should not be approved until identity and address verification are complete. Current law outlines the address verification process, but the important step of identity verification is missing. - The law should emphasize that a person who is not a citizen of the US, will not be allowed to vote which is consistent with a recent amendment to the NC Constitution.* (* Only a citizen of the US who is 18 years of age and possessing the qualifications set out in this article, shall be entitled to vote at any election by the people of the State, except as herein otherwise provided.) - The President’s Executive Order 14248 requires proof of citizenship to register to vote, so that proof should be a qualification. - With the number of illegal immigrants in the country we need assure that “only citizens vote”.
Use of HAVA (Help America Vote Act) documents* - HAVA documents should be used to verify address, not to verify identity. (* a current utility bill, bank statement, government check, government paycheck or other government document) - HAVA documents are easily forged. - Current law requires that efforts be made to obtain information to verify the identity during the registration process, not when they show up to vote. - If voter’s lose confidence in the election system, they may be less inclined to vote, believing their vote will be cancelled by ineligible to voters. When Driver's License and Social Security Numbers Can Not Be Verified - It is not a best practice to use HAVA documents to verify identity. The BOE should be in contact with the applicant to obtain information to see if there are errors in names and birthdates, for example. - Verifying identity is a key to a trustworthy voter registration database. It is a priority in our country.
Poll Observers - The law currently requires that observers can only be appointed by the political party, if they have a candidate in the race. The appointment of poll observers by political parties should be permitted regardless of whether they have a candidate on the ballot. There may also be other items on the ballot that warrant observers. Same Day Registration (SDR) - The registration process must be the same for all registrations. With SDR all applicants are not being treated equally. The only remedy is to eliminate same day registration of voters. SDR opens the door for election fraud because address verification mailings cannot be completed before election day. SDR is an undue burden on election officials. The National Voter Registration Act requires that registrations are completed at least 30 days before the election. Public Records Requests When the public submits Public Record Requests to the State Board of Elections, responses are currently provided to the individual making the request. It would be very beneficial to require the State Board of Elections to publish Public Record Requests and responses on its existing public records portal, increasing transparency, reducing duplicative work, and building public trust—at virtually no additional cost. Goal: Require NCSBE to publish public records requests & responses on its existing portal. Transparency: Make requests and responses visible to all citizens—not just the individual requester. Efficiency: Prevents duplicate requests; saves staff time & taxpayer money. No New Cost: Uses current Request portal (already in place). Privacy Safe: Publishes exactly the same records already sent to the requester (with confidential info already redacted). Builds Trust: Shows elections agency has nothing to hide. Ask: This suggestion is straightforward, uses existing tools, costs essentially nothing extra, and delivers real benefits in transparency and efficiency. It’s a common-sense improvement that strengthens trust in North Carolina’s election administration. |
The Good Parts: The bill bans Ranked Choice Voting, modifies vote counting and absentee ballot management, allows the Auditor to convert 25 personnel positions into exempt status allowing new hires, requires voter ID with UOCAVA ballots, amends campaign finance reporting, and requires NC School of Government to aid in training curriculum development.
The Bad Parts: There are two sections in the bill that are of grave concern and must be fixed to assure election integrity. They are
1) Contributions by Foreign nationals in our elections
2) Verification of Overseas Voters’ Addresses, Voter Registration, Voter Application, and Voter Verification
