NCEIT Initative for Modifying the Administrative Code for Elections: (Joan Roan- Team Leader) 22 Chapters under NCAC Title 08 (Elections). Roughly 99 unique rules; of which 38 are presently under consideration for necessity. By contrast there are approximately 392 general statutes in 25 Articles governing elections. Joan and her team have completed their preliminary review of the 38 rules and compiled their comments. On the Tuesday, Oct 14 statewide call, we will review the rules and provide talking points. PLEASE comment.


NCEIT believes the instructions in all Numbered Memo's should be codified into the Administrative Code to give them the force of law.


The state is requesting public comments on the above rules. The comment period – which began Monday, August 11 and ends on Friday, October 17, 2025 – is part of a required statutory review.


Under N.C.G.S. § 150B-21.3A, state agencies must review their rules every 10 years and decide if those rules are necessary or unnecessary. A rule is unnecessary if it is “obsolete, redundant, or otherwise not needed.” A necessary rule is any rule that does not fit the definition of an unnecessary rule.
