08 NCAC 18 .0201: Definitions – This rule provides definitions for terms used in the other rules.



Rationale:   

Make clarification of Absentee Ballot Packages by differentiating them as “Mail-Out” and “Return” packages.  Amend the original (Mail-out) definition and add another (Return) definition to be used in subsequent rulemaking.  Additionally, eliminate the term ”Irregularity” as it is a vague and ambiguous term that isn’t needed in describing Absentee Ballot Return Packages.  

 

Justification: 

1.           Absentee Ballot Packages are mailed out and returned, once completed by voters.  The contents of these two packages are different.  Mail-out Packages have certain contents that voters must use and complete to accomplish mail-in voting successfully.  Return packages must be completed to a defined standard for acceptance.   These definitions clarify what is mailed out and returned, eliminating confusion or ambiguity about the respective packages and what is expected from voters.    

 

2.           Irregularities are simply deficiencies by another name.  Introducing this vague term to election officials complicates the decision process for managing Absentee Ballot Return Packages.  Eliminating the term “irregularity” simplifies the reasoning and processing of Absentee Ballot Return Packages.
