Proposed rule 08 NCAC 18 .0505: Irregularities That Require Further Action – This rule identifies irregularities that must be documented and the voter contacted to determine whether the issue can be cured or must result in the ballot being spoiled and reissued.
Rationale:
This rule is not needed. The term “irregularity” can be eliminated as unnecessary, and the instructions in this proposed rule can be migrated into 08 NCAC 18.0502 (Curable Deficiencies).
Justification:
1. Eliminating this rule and migrating certain content into 08 NCAC 18.0502 simplifies the process for managing deficiencies in absentee ballot return packages from voters.
2. The processing of curable and non-curable absentee ballot return packages is adequately described in 08 NCAC 18.0502 and .0503.
