Please rephrase the Rationale and Justification for the First Recount so the NCSBE treats each submission separately.

1. Suggestion: Section (b): Reorganize section (b) to move the definitions of the teams to the beginning of the section and clearly identify the functions required and the staff assigned to each function. Therefore, sections should be added for Tabulators and Ballots with their respective staff.
Rationale: Section (b) was difficult to follow for those not familiar with the process. One large paragraph which included many parts needed to be broken up for clarity. Currently the topics jump around from tabulator to ballot functions. The definition of the teams was at the end of the paragraph instead of the beginning.
2. Suggestion: Section (c) (2): Add in the ballot duplication process to mark the ballot as VOID and preserve the voided ballot for accountability purposes.
Rationale: Directions are needed for how the poll workers handle the voided ballot during the ballot duplication process.
3. Suggestion Section (c) (1) and (2): The reference of “Rule .0109 of this Chapter” should be changed to 08 NCAC 09 . 0109 regarding the intent of the voter on the ballot to allow easy access to the appropriate rule.
Rationale: The change is needed to provide easy access to the rule and avoid looking up the wrong .0109 rule.
4. Suggestion: Title: Change the title to Machine Recount or First Recount- Machine
Rationale: A more descriptive title would be helpful and be consistent between the sections.
5. Suggestion: Delete discussion of machine recount in section 08 NCAC 09 .016 and move it to this section.
Rationale: The Recount section is not organized so that all the information on one topic is in one place. The General Guidelines section paragraph (f) discusses machine recounts which should be moved to this section.
6, Suggestion: (b): Add a sentence indicating that the tabulator used for the recount should be different from the tabulator used for the original count.
Rationale: If the tabulator is not functioning properly, the same errors will occur in the recount.
