Dear Mr. Burgos:

I am writing to formally comment on the First Recount Rule, 09.0107.

Suggestions

Section (b):  Add a sentence indicating that, in order to remove the risk of machine calibration error affecting the vote count, the tabulator used for the recount should be different from the tabulator used in the original count.

Section (c) (1) and (2): Reference to “Rule .0106(d)” should be changed to “08 NCAC 09 .0106(d)” and reference to “Rule .0109” should be changed to “08 NCAC 09. 0109.”
